Where the Payment of Bonus Act applies?

The payment of bonus act applies to:
1) Every Factory or
2) Any Establishment which has 20 or more employees. Once the provisions of this act become applicable, it will continue to apply even if the number of employees falls below 20.
3) Any Establishment employing less than 20 but not less than 10 in number, provided the Act is made applicable by the Government by way of notification in the Official Gazette.
