Are you filing an income tax return? You have to understand all the required matters and manners to be included in your income tax return. Many taxpayers like you have received a notice of defective return from the department. What makes your return defective? Here I have listed down the reasons that steer a return defective.

Tax department sends a notice of defective notice under section 139(9).


When your return is treated as a defective return?


Any of the following points might be the reasons that make your return defective.


  1. You do not furnish all the required information or documents while filing your return.
  2. You filed a return in invalid format i.e you have to choose the appropriate form to disclose your income like ITR 1, ITR-3 based on your nature of income.
  3. You claimed a refund of TDS but you did not provide the details of income in respect of such TDS.
  4. If you are liable to maintain financial statement(P& L, BS) but did not fill it in your return.
  5. You are you liable for audit but failed to submit the same.



So please ensure that you have provided all the information required to furnish in your return.

If you missed providing all the information, your return will be treated as a defective return. Then the department sends you a notice of defective return under section 139(9).


Have received a notice of defective return?

Do not get panic. If you got this notice, you are required to revise your return. You have to file a revised return within fifteen days of a notice.


How can you revise your return in response to the notice?


  1. Download Income Tax Return from income tax portal.
  2. Fill an income tax return. Note that you have to fill response to a notice of defective return in place of original/revised return provided in earlier return.
  3. Generate XML of return.
  4. Log in to income tax portal with ID password.
  5. Go to e-file> Response to notice u/s 139(9)
  6. Upload XML of return
  7. Submit your return


That's it. You have completed the response to the notice.
