In the matter of Ome Prakash Verma Vs. Amit Jain (RP of Neesa Leisure Ltd.) & Ors. CA (AT) (Ins) No. 1095 of 2020

This appeal came up for consideration on 22nd December, 2020, when Mr. Rachit Srivastava, Advocate appeared as proxy counsel seeking adjournment on the ground that learned counsel for the Appellant, Mr. Uday Bedi, was unable to join on account of some personal difficulty. The appeal was adjourned to 5th January, 2021, on which date, Ms. Romila Mandal, Advocate appeared as proxy counsel on behalf of Mr. Garvit Khandelwal, Advocate seeking adjournment again on the ground that Mr. Garvit Khandelwal had filed his vakalatnama a day before but on account of his professional engagement at Jaipur, he was unable to attend the hearing. The matter was again adjourned for today with express condition that no request for further adjournment will be entertained.

Today, Ms. Varsha Sharma claims to be appearing as proxy counsel on behalf of Mr. Garvit Khandelwal, counsel for the Appellant seeks further adjournment on the ground that Mr. Khandelwal is not available to address the court. Having regard to the developments referred to hereinabove, prayer for further adjournment is rejected. The appeal is accordingly dismissed for non-prosecution.
