Learned counsel for the Appellant submits that after Terms of Settlement was brought to the notice of this Appellate Tribunal and also to the Adjudicating Authority (National Company Law Tribunal), Mumbai Bench, Mumbai, the Adjudicating Authority by order dated 13th November, 2019 dismissed the application under Section 9 in view of the Terms of Settlement and both the appeals have become infructuous. It is also accepted by learned counsel for the Interim Resolution Professional.

In view of the above, both the appeals are disposed of as infructuous. Let a copy of order dated 13th November, 2019 passed by the Adjudicating Authority (National Company Law Tribunal), Mumbai Bench, Mumbai be kept on record.
