Counsel for Appellant Mr. Neeraj Kumar and Advocate Ms. Asmita Chaudhary appearing for Respondent No.1 submit that the parties have already settled and Application under Section 12(A) of I&B Code has been accepted by the Adjudicating Authority and that the Financial Creditor has withdrawn the proceedings before the Adjudicating Authority (National Company Law Tribunal) New Delhi Court No. IV and that the Adjudicating Authority has disposed off Company Petition (IB).3085/ND/2019 as withdrawn.

Counsel for the Appellant submits that he has instructions to withdraw the present Appeal. Counsel for Respondent No. 1 does not object. None present for the Resolution Professional.

The Appeal is disposed off as withdrawn without liberty to challenge the same impugned order.
