Two steps, yes, just take these 2 steps to appoint a lawyer for your society. A society, registered under the Societies registration act, has a separate legal existence from its members. It can hold properties in its name. However, if someone has to sue a society, the suit would be filed in the name of the president of the society. Weird as it may seem, it is now on the president to defend the suit. What would the president do?

And here are the 3 steps:

  1. Hold the governing body meeting
  2. Pass a resolution to appoint the lawyer.
  3. Issue the power of attorney


Although there could be many ways to do the above steps. But the simplest one that I suggest are:


Step # 1 - Hold the governing body meeting:


  1. Preparation for Holding governing body meeting:
  2. Draft a resolution.
  3. Prepare the notice to hold meeting.

  4. Prepare the power of attorney.
  5. Actual holding of meeting:
  6. Holding the Pass the resolution.


And that's all. You have hired a lawyer. Now it's his job to represent your case.

Issue a power of attorney in the name of the lawyer.
