Reviving Inoperative PAN for NRIs: A Roadmap for Those Without Aadhaar

On paper, Non-Resident Indians (NRIs) without Aadhaar are exempt from linking PAN-Aadhaar. Which should theoretically protect their PAN from becoming inoperative. However, in practice, this has not been the case because of potential discrepancies in the residential status recorded with the Income Tax Department.

If you go by PAN-Aadhaar linking guidelines, then NRIs without Aadhaar are exempt from linking PAN-Aadhaar. That means the income tax department can't make their PAN inoperative, right? Well, theoretically, yes... But practically, it's a different story.


Here's the situation:

Say, you're an NRI... And your residential status isn't updated as 'non-resident' in the Income Tax records.


As a result, the income tax department considers you a resident. So the tax department expects you to have connected your PAN with the Aadhaar.


And because you didn't connect Aadhaar with PAN, so the tax department made your PAN inoperative.


So, what's the solution?

You should update your residential status from resident to non-resident in the income tax records.


You should file an application with the tax officer, stating that you are not required to link PAN and Aadhaar because you're non-resident.


You should submit these documents along with your application.


-> A copy of your PAN Card (self-attested)

-> A copy of your Passport (self-attested)

-> Details of your stay outside India.


How can you apply?

You can email the assessing officer or post the application for a change of residential status from resident to non-resident.

You can find the email address of the assessing officer via the 'Know your AO' section on the income tax e-filing portal.

You should email from your registered email and definitely attach the requisite documents to your email.


In case you're in town, then you can personally visit the tax officer and submit your physical application accompanied with the requisite documents.


Once the tax department changes your residential status in its records, your PAN will become operative again.


So, while the theory suggests that NRIs without Aadhaar are safe from their PAN becoming inoperative, the reality requires a bit more diligence and action on your part. But with the right steps, you can ensure your PAN remains operative and your financial activities remain uninterrupted.
