Synapse Communications Pvt Ltd provided IT Solutions. Defendant was employed as Sr. SEO Executive with Synapse. Defendant had executed an indemnity bond with an undertaking to pay Rs.2,00,000 for her training etc to the company, in case she left the job. Synapse terminated her services when she did not resume work. It invoked indemnity bond. Civil Judge held in Synapses favour, and ordered defendant to pay the amount with interest.
2 .The defendant was employed as Sr. SEO Executive in the palintiff company.
3 . As per the terms contained in the appointment letter an Indemnity Bond was executed by the defendant wherein she undertook to pay Rs.2,00,000 towards the contribution/liability ofher training etc to the company, in case the defendant left the job.
4 .The defendant neither resumed the work nor responded to the letters sent to her by theplaintiff company.
5 .The services of the defendant stood terminated and the Indemnity Bond stood invoked.The Civil Judge held as under:
6 .I am of the considered opinion that the plaintiff has shown that the defendant has breached the conditions of the appointment letter.
7 .Therefore, she is liable to pay the amount mentioned in the indemnity bond.
8 .The plaintiff is also entitled to interest @ 6% per annum.
