The appellant prays for and is allowed to file an application within a
week for substitution of Appellant by an aggrieved person such as
Director/Shareholder and transpose the Appellant as 3rd Respondent.
As the appeal is not maintainable at the instance of the ‘Corporate Debtor’ in view of the decision of the Hon’ble Supreme Court in Innoventive Industries Ltd. V/s ICICI Bank 2018 (1) SCC 407 (Para- 11), learned counsel for the appellant prays for and is allowed to file an application within a week for substitution of Appellant by an aggrieved person such as Director/Shareholder and transpose the Appellant as 3rd Respondent.
Post the appeal ‘For Orders’ on 17th January, 2020 along with substitution petition.
