In spite of the time given to the appellant, no petition has been filed for substitution of appellant by one of the shareholder/Director of the ‘Corporate Debtor’. In the circumstances, as the appeal is not maintainable at the instance of the ‘Corporate Debtor’ through its earlier management in view of the decision of Hon’ble Supreme Court in “Innoventive Industries Ltd. v. ICICI Bank (2018) 1 SCC 407] ” (Para 11), we dismiss the appeal as not maintainable. No cost.
