In the matter of Anuj Jain Interim Resolution Professional Jaypee Infratech Ltd. Vs. NBCC (India) Ltd. & Ors.CA(AT)(Ins)No. 486 of 2020

Issue raised in this Appeal filed by 'Interim Resolution Professional' is limited to certain observations made in para 103 of the impugned order dated 3rd March, 2020 in terms whereof resolution plan has been approved.

The Resolution Plan has already been assailed by NBCC - "Successful Resolution Applicant' in regard to some modifications and interim monitoring committee has been constituted on 22nd April, 2020 for implementation of the approved resolution plan which has been subjected to the outcome of those Appeals.

Issue notice upon Respondents through Speed Post. Requisites along with process fee be filed within one week from today. If e-mail addresses are provided by the Appellant, notices may be sent through the mode of e-mail also within the same period. At this stage, Mr. Prateek Kumar, Advocate accepted notice on behalf of the Respondent No. 1 - NBCC (India) Limited. He may file Reply Affidavit along with Vakalatnama within two weeks.

List the Appeal 'For Admission (After Notice) on 19th June, 2020 along with Company Appeal (AT) (Ins.) No. 475 of 2020.
