In the matter of Arcelormittal India Pvt. Ltd. Vs. SREI Infrastructure Finance Ltd. & Ors. CA(AT)(Ins)No. 747 of 2020

After hearing Shri Harish Salve, Senior Advocate representing the Appellant, Mr. Abhijeet Sinha, Advocate representing Respondent No. 1 and Mr. Rishav Banerjee, Sr. Advocate representing Respondent No. 2 and wading through the impugned order, we find that pleadings before the Adjudicating Authority (National Company Law Tribunal), Ahmedabad Bench have been completed and the Adjudicating Authority has shown its firm resolve to dispose off the applications pending consideration as early as possible.

As it has been pointed out that the question of jurisdiction has been raised before the Adjudicating Authority which goes to the very root of the matter, we dispose off this appeal with direction to the Adjudicating Authority to procced on merit addressing the issue of jurisdiction raised before it, without any further loss of time.
