The Adjudicating Authority refused to exclude any period for the purpose of Liquidation on the ground that the fees of the Liquidator had not been fixed.
This appeal has been preferred by Liquidator of LML Ltd. against order dated 22nd October, 2019 passed by the Adjudicating Authority (National Company Law Tribunal) Allahabad Bench. The Adjudicating Authority refused to exclude any period for the purpose of Liquidation on the ground that the fees of the Liquidator had not been fixed.
In fact, no case has been made out for exclusion of any period, even if an appeal was pending before the NCLAT, in absence of any specific stay of liquidation process by this Appellate Tribunal. The appeal is frivolous and is dismissed.
