2. I.A. No. 2506 of 2021 has been filed by the Appellant on 16.11.2021 stating that the parties have settled the matter amicably and they do not want to pursue the instant Appeal.

3. When the case is called out, Learned Counsel for the Appellant screen- shares the Order of Hon’ble Supreme Court of India in Civil Appeal No. 6798 of 2021 in the matter of Bharat Bhushan Kumar Vs. Spaze Towers Pvt. Ltd. & Ors. dated 18th November, 2021 whereby Hon’ble Supreme Court of India has annulled the proceedings in CP No. IB 889/ND/2020 and disposed of the same.

4. Accordingly, Learned Counsel for the Appellant seeks permission to withdraw this Appeal along with I.A. No. 2506 of 2021.

Permission accorded. The Appeal is dismissed as withdrawn.
