In the matter of Committee Creditors of Asian Colour Coated ispat Ltd. Vs. Shri K.K Bassi, Resolution Professional of Asian Colour Coated Ispat Ltd. & Ors. I.A No. 4322 of 2019 in CA(AT)(Ins) No. 1414 of 2019

Learned Counsel for the Appellant has brought to our notice the incorrect quotation of the impugned order dated 2nd December, 2019 passed by the Adjudicating Authority (National Company Law Tribunal), Principal Bench, New Delhi, which was under challenge. The said order reads as follows:

“Although the matter is part heard the same may be heard by any available Bench.

List on 08.01.2020.”

2. In the circumstances, there being a wrong quotation in the order dated 9th December, 2019, we recall that part of the order dated 9th December, 2019 and whole order should be read as follows:

“9.12.2019- The Appellant has challenged the order dated 2nd December, 2019 passed by the Adjudicating Authority (National Company Law Tribunal), Principal Bench, New Delhi which reads as follows:

“Although the matter is part heard the same may be heard by any available Bench.

List on 08.01.2020.”

Having heard learned counsel for the Appellant and Respondents, we are not inclined to interfere with the impugned order. However, we accept that the Adjudicating Authority will deliberate the issue on 8th January, 2020 when the matter is fixed and dispose of the matter expeditiously which is pending since long. The appeal stands disposed of. No costs.”

3. The Office is directed to make necessary typographical correction in the order dated 9th December, 2019 as pointed out and ordered above. Let corrected certified copy of the order be forwarded to the parties. I.A. No.4322 of 2019 stands disposed of.
