In the matter of Hitesh R. Jobalia Vs. Dena Bank (Now known as Bank of Baroda) & Anr. CA(AT)(Ins)No. 1135-2019

The Appellant has filed this Appeal against the order dated 5th September, 2019, which reads as follows:

“Heard the argument of the Ld. Counsel for the Financial Creditor. the petition is admitted. Mr. Fanendra H. Munot, having Reg. No. IBBI/IPA-001/IP- P00515/2017-18/10916 is appointed as IRP.”

It is stated that thereafter no final judgment is delivered. However, it has come to our notice that the Hon’ble Member (Judicial) had already relinquished the charge from the post and that was the reason for non-delivery of the judgment.

In the circumstances, we allow the Appellant to mention the matter before the concerned Bench of the ‘National Company Law Tribunal’, Mumbai Bench, Mumbai to pass a ‘Reasoned order’ uninfluenced by the impugned order dated 5th September, 2019.

The Appeal stands disposed of.
