Learned Counsel for the Appellant is not present. On last date i.e. 19th February, 2020 also learned counsel for the Appellant was not present.

Today when the matter was called out earlier, none appeared for Appellant. Even on second call, nobody is present.

Learned Counsel for Respondent refers to proceedings dated 20th November, 2019 to submit that the Learned Counsel for the Appellant had stated that the Appellant is ready to settle the claim of Respondent. It is stated that the Appellant however, never contacted the Respondent. Learned Counsel states that the Corporate Insolvency Resolution Process is continuing.

As the Learned Counsel for the Appellant was not present on last date and is not present even today, nor the Appellant is present, the Appeal is dismissed in default.
