Heard learned counsel for the Appellant as well as learned counsel appearing for the Respondent.

2. This Appeal has been filed against the order dated 03.05.2021 passed by the Adjudicating Authority (National Company Law Tribunal), Ahmedabad Bench by which order the Application filed under Section 9 of the I&B Code by the Appellant has been rejected.

3. In this Appeal the parties have filed an application bringing on record Settlement dated 30.04.2022. Learned counsel for the Appellant submits that this Appeal be decided in terms of the Settlement. Settlement dated 30.04.2022 between the parties is taken on record. Parties shall abide by the terms of Settlement dated 30.04.2022.

4. In view of the aforesaid, we permit the Appellant to withdraw this Appeal, taking the aforesaid settlement on record. The Appeal is disposed of accordingly.
