The prayer is allowed to withdraw the Appeal so far as the liberty is concerned the Appellant is permitted to avail the remedy an available under the law. We are not expressing any opinion whether suit is barred by limitation which is determined by Court of jurisdiction.

Learned counsel for the Appellant sought permission to withdraw the Appeal to enable the Appellant file a suit against the ‘Corporate Debtor’. As requested, the prayer is allowed to withdraw the Appeal so far as the liberty is concerned the Appellant is permitted to avail the remedy an available under the law. We are not expressing any opinion whether suit is barred by limitation which is determined by Court of jurisdiction.


The Appeal stands disposed of as withdrawn without any liberty to challenge the same very impugned order dated 27th September, 2019.
