Mr. Kaustav Saha, Advocate representing the Appellant submits that during pendency of this Appeal, the Adjudicating Authority has passed order under Section 12A of the Insolvency & Bankruptcy Code, 2016 based on settlement arrived at between the Operational Creditor and the Corporate Debtor before the Constitution of the Committee of Creditors.

Learned Counsel filed photocopy of the order dated 06th January, 2020 passed by the Adjudicating Authority – National Company Law Tribunal Division Bench, Chennai. Same is taken on record. In view of this subsequent development nothing survives for consideration in this Appeal as the matter stands closed. The Appeal is accordingly, disposed of.
