Learned Counsel for the Respondents is also present The matter was listed yesterday i.e. 30.06.2021 under the heading ‘For Admission (After Notice)’. Yesterday, the Learned Counsel for the Appellant have screen short the Order dated 17.06.20210 passed under Section 12A read with Regulation 31A & 60 (5) read with Rule 11 of NCLT Rules, 2016 passed in I.A. No. 89 (MP) 2021 in TP 196 of 2019 [CP (IB) 44 of 2019] passed by the National Company Law Tribunal, Indore Bench at Ahmedabad the application was filed on behalf of the parties.

Parties were directed to withdraw the application that CP (IB) 44 of 2019. Further, the Corporate Debtor is release from the CIRP.

Learned Counsel for the Appellant was directed to file soft copy of the Order in the course of the day and the matter was directed to be list on 01.07.2021. Learned Counsel for the Appellant had complied the order and the matter is listed today.

In view of the fact that the Learned Counsel for the Appellant have entered in to the Terms of Settlement with the Respondent and application under Section 12A read with Regulation 31A & 60 (5) read with Rule 11 of NCLT Rules, 2016 in CP (IB) 44 of 2019 was withdrawn.

The instant appeal bearing no. Company Appeal (AT) (Ins.) No. 67 of 2021 filed on behalf of the Appellant is permitted to be withdrawn and accordingly is “dismissed as withdrawn”.

The Registry is directed to upload this Order on the website of this Appellate Tribunal.

Registry is directed to send a copy of the Order to the National Company Law Tribunal, Indore Bench at Ahmedabad.
