The learned Counsel for the Appellant submits that the parties have already settled the matter and the Adjudicating Authority (National Company Law Tribunal, Kolkata Bench, Kolkata) has disposed of the Petition, by Order dated 23rd September, 2019 which is tendered and reads as follows:-

Ld. Counsel for the operational creditor as well as corporate debtor appears. Corporate Debtor is admitted in CIRP by order dated 7th August, 2019. However, parties have settled the dispute. It is seen from the record that IRP did not make public announcement. He did not call for claims from the creditors. CoC is not formed. Since parties settled dispute, we dispose off this proceeding, in view of Rule 11 of NCLT Rules because parties have settled the dispute. CP(IB)286/KB/19 stands disposed off.”

In the facts of circumstances, the Appeal is disposed of as infructuous.
