The Application has not been decided by the Ld. Adjudicating Authority after passing about 16 months. Therefore, Ld. Adjudicating Authority may be issued a direction to decide the Application expeditiously. So the liquidator can conclude the liquidation proceedings in time frame.

Heard Ld. Counsel for the Appellant, he submitted that the Appellant being a liquidator filed an Application I.A. No. 149 of 2020 on 28.02.2020 seeking direction against the Respondents to vacate the factory premises. However, the Application has not been decided by the Ld. Adjudicating Authority after passing about 16 months. Therefore, Ld. Adjudicating Authority may be issued a direction to decide the Application expeditiously. So the liquidator can conclude the liquidation proceedings in time frame.


Ld. Counsel for the Appellant submits that he has sent the advance notice of this Appeal to the Respondent Counsels. However, nobody gave appearance on behalf of the Respondents.


We have considered the submissions; we request Ld. Adjudicating Authority to decide the I.A. No. 149 of 2020 expeditiously which is pending since 28.02.2020 preferably within one month.


Thus, the Appeal is disposed of with the aforesaid direction. No order as to costs.

Registry is directed to send the copy of this order to the concern Adjudicating Authority.
