voting shares and thereby allowed the Applicant to withdraw the Company Petition. The present Appeal, thus, become infructuous.

Learned Counsel for the Appellant submits that the Adjudicating Authority (National Company Law Tribunal), Bengaluru Bench vide its order dated 22nd August, 2019, accepted the application under Section 12A of the Insolvency and Bankruptcy Code, 2016 (for short the ‘I&B Code’) approved by the ‘Committee of Creditors’ with more than 90% of voting shares and thereby allowed the Applicant to withdraw the Company Petition. The present Appeal, thus, become infructuous.


The Appeal is accordingly disposed of as infructuous.
