In the matter of Mr. Rajnishpal Singh Dhaliwal Vs. Nilkamal Ltd. & Ors. CA(AT)(Ins)No. 465 of 2020

After arguing for a while and being confronted with the fact that the ‘Corporate Debtor’ has chosen not to attend the proceedings before the Adjudicating Authority (National Company Law Tribunal), Chandigarh Bench, Chandigarh and has also not filed reply to the application filed under Section 9 of the Insolvency and Bankruptcy Code, 2016 by the Respondent- ‘Operational Creditor’, learned counsel for the Appellant seeks to withdraw the appeal. The appeal is dismissed as withdrawn. However, dismissal of this appeal will not preclude the ‘Corporate Debtor’ from raising all relevant issues before the Adjudicating Authority.
