What remedies are available to me if the cheque presented to me by the payer has bounced, and he refuses to communicate with me in this regard?
You can make a complaint.
You should file a case in a court which comes under the jurisdiction (coverage area) of the branch where you presented the cheque.
Say if you live in Gurgaon but you have presented the cheque for clearance in Noida, then the case will be filed in the concerned court of saket.
Needless to say, it is better to present the cheque carefully nearby your area/branch only in order to save yourself from further harassment. Court is a tedious affair.
Outcome of Cheque Bounce Cases
In such cases, the court already assumes that the accused, being your payer, is at fault.
The court assumes that the accused person has to pay because when a person signs a cheque and hands it over to other person, then definitely there will be some liability on the accused.
Thus, the burden of proof lies on your payer. You do not need to prove your case. The payer, in your case will explain the case and make your payment, including any damages you suffered due to such dishonour of cheque.
