Ms Sushma Mishra was appointed as S.E (PHP) in the plaintiff company. She executed an indemnity bond for Rs 2 lakhs in case she left the job within 24 four months of joining. She left the job without completing the requisite period. Plaintiff filed a suit for recovery. The Civil Judge held that defendant had admitted the liability to pay amount of Rs 2 lakhs. 1. Ms Sushma Mishra was appointed as S.E (PHP) in the plaintiff company.
2. She executed an indemnity bond giving an undertaking that in case she left the job within 24 four months of joining, the amount of Rs 2 lakhs shall be payable to the plaintiff company.
3. She left the job without completing the requisite period mentioned in the Indemnity Bond.
4. Sushma issued four cheques in favour of plaintiff company for settlement of account for expenses incurred by company on her training and losses suffered due to incomplete assigned project.
5. Cheques were presented but they were dishonoured.
6. The company filed a suit for recovery.

7. Defendant had admitted the liability to pay amount of Rs. 2,00,000 to the plaintiff company.
8. Entire testimony of PW−1 has gone unrebutted as defendant chose not to contest the matter.
9. Plaintiff is entitled to the amount sought, the suit of the plaintiff is hereby decreed with costs for amount of Rs. 2,00,000 against defendant along with pendente lite and future interest at the rate of 6% per annum from the filing of suit till actual realization.
