Learned Counsel for the Appellant seeks to withdraw the present appeal. Accordingly, he is granted permission to withdraw the instant appeal and the said appeal is dismissed as withdrawn. No costs.

Before parting with the case, this Tribunal based on request of Learned Counsel for the Appellant, permits the Appellant to move an application in terms of the ingredients of Section 12 A of the I&B Code, 2016, coupled with Regulation 30 A of the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate persons) Regulation 2016, within one week from today to seek redressal of the Appellant’s grievances, if the appellant so desires/ advised. Till then, the ‘Committee of Creditors’ will not be constituted, if not yet already constituted.
