The appeal is not maintainable in absence of any order passed by the Adjudicating Authority as there is no cause of action. It is stated that an application filed u/s 7 of the ‘Insolvency and Bankruptcy Code, 2016’ is pending before the Adjudicating Authority (National Company Law Tribunal), Allahabad Bench since September, 2018. We expect the Adjudicating Authority will pass the appropriate order after hearing the parties (Corporate Debtor) preferably within six weeks.
