As it is informed that the ‘Corporate Debtor’ has already appeared and pleading is complete, we hope and trust that the Adjudicating Authority (National Company Law Tribunal), Kolkata Bench, Kolkata, will pass appropriate order on an early date either admitting or rejecting the claim preferably by the next date.
Learned counsel for the Appellant submits that the application under Section 7 of the Insolvency and Bankruptcy Code is pending since August, 2017 and the matter is being adjourned from time to time. However, on such ground, we cannot interfere with the order of adjournment dated 7th September, 2018 as it appears that the ‘Corporate Debtor’ has not appeared and for that notice has been given.
