The appeal is accordingly dismissed as withdrawn, but without any liberty to challenge the same very impugned order.

Mr. Rajiv Ranjan, learned Senior Counsel along with Mr. Saumabo Ghosh prays for and is allowed to withdraw the appeal to enable the Appellant to settle the claim with the Respondent- ‘Axis Bank Ltd.’.

The appeal is accordingly dismissed as withdrawn, but without any liberty to challenge the same very impugned order. However, this order will not come in the way of the Appellant to settle the matter with the Respondent.
