It is represented on behalf of both sides that Form FA 3 was filed by the Interim Resolution Professional before the Adjudicating Authority through an Interlocutory Application and hence, till the disposal of the said Interlocutory Application by the Adjudicating Authority the implementation of the impugned order shall remain stayed.
Learned Counsel for the Appellant Mr. Himanshu Singh informs this Tribunal that full amount was paid on 22.06.2022 to the Respondent/Small Industries Development Bank of India. And this fact is not disputed by the Learned Counsel Mr.Mohd. Monnis Abbasi appearing for the Respondent/ Bank of India.
In view of the fact that the amount was paid in full, this fact is not denied on the side of the Respondent, the Learned Counsel for the Appellant seeks permission from this tribunal to withdraw the instant CA (AT) (Ins) No. 708 of 2022. Acceding to his said request, the instant CA (AT) (Ins) No. 708 of 2022 is dismissed as withdrawn. No costs.
Before parting with the case, it is represented on behalf of both sides that Form FA 3 was filed by the Interim Resolution Professional before the Adjudicating Authority through an Interlocutory Application and hence, till the disposal of the said Interlocutory Application by the Adjudicating Authority the implementation of the impugned order shall remain stayed. With the above said observations and directions, the instant CA (AT) (Ins) No. 708 of 2022 shall stand disposed of.
